1. Who we are
Novaire is operated by Pádraig O’Driscoll, an individual based in Ireland, trading as Novaire (“we”, “us”, “our”). By creating an account or using Novaire, you are entering into an agreement with Pádraig O’Driscoll.
You can contact us at novaireireland@gmail.com.
2. Acceptance of these terms
By accessing or continuing to use Novaire you agree to these Terms & Conditions, our Privacy Notice and our Refund Policy. If you do not agree, please do not use the service.
3. The service
Novaire is an online platform providing digital study and academic organisation tools for university students, including organising modules and course material, AI-generated notes, summaries, flashcards, quizzes, a study tutor, revision planning and progress tracking.
You must be at least 16 years old, or the age of digital consent where you live, to use Novaire. If you use Novaire on behalf of an organisation, you confirm you have authority to bind it to these terms.
4. Your account
- Provide accurate information and keep it up to date.
- Keep your login details confidential. You are responsible for activity under your account.
- Tell us promptly if you believe your account has been accessed without permission.
5. Novaire Pro subscription
Novaire offers a free plan with monthly usage limits and an optional paid plan, Novaire Pro. Novaire Pro is a recurring subscription, currently priced at €6.99 per month. It renews automatically each month until you cancel. Prices shown at checkout include any applicable VAT.
You can cancel at any time from the Billing page in your account. Cancellation takes effect at the end of your current billing period, and you keep Pro access until then. We may change the price in future; we will tell you in advance and any change will apply only from your next billing period after notice.
6. Payments and our reseller
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, taxes, renewals, cancellations and refunds are also governed by Paddle’s Buyer Terms. Refunds are described in our Refund Policy.
7. Acceptable use
You must not:
- use Novaire for any unlawful purpose, or for fraud, spam or academic misconduct prohibited by your institution;
- upload or record material you do not have the right or permission to use, or that infringes anyone’s intellectual property or privacy;
- interfere with the security or operation of the service, including introducing malware, probing for vulnerabilities, or scraping;
- attempt to bypass usage limits, circumvent safeguards on the AI features, or use them to create unlawful, harmful, hateful or deceptive content;
- reverse engineer, resell, sublicense or redistribute the service.
8. Your content and AI outputs
You keep ownership of the material you upload. You give us a limited licence to store and process it solely to provide Novaire to you. You are responsible for having the rights to what you upload and for how you use the outputs.
AI-generated notes, answers and quizzes can be incomplete or inaccurate. Always check them against your course material. Readiness indicators are study aids, not predictions of grades. Novaire is not a substitute for professional, legal, medical or financial advice.
We may remove content or restrict features where content appears unlawful or infringing. Rights holders can report content to us, and we may suspend accounts for repeated infringement.
9. Our intellectual property
We own the Novaire service, software, design, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use Novaire under your chosen plan while these terms apply.
10. Availability
We work to keep Novaire reliable, but we do not guarantee it will be uninterrupted or error-free. We may update, change or pause features, for example for maintenance or security.
11. Suspension and termination
We may suspend or end your access if you materially breach these terms, fail to pay, create a security or fraud risk, or repeatedly or seriously break our policies. You can stop using Novaire and delete your account at any time. When an account is closed, its data is deleted as described in our Privacy Notice.
12. Liability
To the fullest extent permitted by law, Novaire is provided “as is” without implied warranties of merchantability or fitness for a particular purpose. We are not liable for indirect or consequential loss, such as loss of data, profits or academic results. Our total liability is limited to the amount you paid us in the 12 months before the claim.
Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or your statutory rights as a consumer under Irish and EU law.
13. General
We are not responsible for delays caused by events outside our reasonable control. You may not transfer your account without our consent. We may update these terms; if changes are significant we will notify you in advance. These terms are governed by the laws of Ireland, and the Irish courts have jurisdiction, without affecting any mandatory consumer rights you have where you live.
